SCOTUS Matters

John McCain on Friday described the decision by the Supreme Court to allow Guantánamo Bay prisoners to challenge their detention in US courts as "one of the worst decisions in the history of this country".

The Republican presidential candidate said he agreed with the four dissenting justices on the nine-member court that foreign fighters held at the detention camp were not entitled to the rights of US citizens.

Who are those four?  Arch social and fiscal conservatives like  Chief Justice John Roberts (age 53) and Justices Antonin Scalia (72), Clarence Thomas (59) and Samuel Alito (58).

This is the kind of justice that John McCain would select.

These four have the average age of 60.5 years old.  Opposed to 74.2 of the more moderate remaining five.

The odds are very high that the next presidential term will see a retirement of one or more of the more moderate justices.

This would give the conservatives a solid majority on the court.

And what does John McCain think of Roe v Wade?

John McCain believes Roe v. Wade is a flawed decision that must be overturned, and as president he will nominate judges who understand that courts should not be in the business of legislating from the bench.

That is what you are fighting for.

Even better, he said he hadn't read the opinion, but that he thought Roberts's dissent had some really good points. Oh, McCain. Will you ever learn?

If SCOTUS court really mattered Barrack Obama would have made sure Hillary received a soft landing.

He was willing to risk the SCOTUS in his quest to kill off Hillary's career.  Its only now that he realizes he doesn't have the votes that he wants unity.
